How to transfer car ownership privately in Australia: state guide

One person handing a set of car keys to another across a desk

Step-by-step guide to transferring car registration privately in NSW, VIC, QLD and WA, with roadworthy rules, notice of disposal, and stamp duty fees.

The two sides of an Australian registration transfer

Transferring vehicle registration in a private sale requires distinct actions from both the seller and the buyer. If either party fails to lodge their paperwork promptly, legal headaches follow quickly.

The seller must submit a Notice of Disposal (or transfer notification) to their state transport department immediately upon handing over the keys. This establishes the exact sale date and time, protecting the seller from future speeding fines, parking infringements, and toll charges incurred by the buyer.

The buyer must lodge an Application for Transfer of Registration within 14 days in most states. Failing to transfer within the statutory window attracts late transfer penalty fees and risks driving an unlicenced vehicle if registration is suspended.

State-by-state roadworthy and inspection requirements

Inspection rules differ significantly across state borders, and confusing them is one of the most common pitfalls for private car buyers in Australia:

  • New South Wales: Light vehicles over five years old require an annual eSafety inspection (pink slip) to renew registration. When transferring an already registered vehicle with current rego, a new pink slip is generally not required unless the registration is expiring.
  • Victoria: A Certificate of Roadworthiness (RWC) issued by a licensed vehicle tester is mandatory for all transfers unless transferring between spouses. The RWC is valid for 30 days from inspection and must be submitted to VicRoads.
  • Queensland: A Queensland Safety Certificate (RWC) must be obtained by the seller before advertising the vehicle for sale. It is valid for two months or 2,000 km (whichever comes first) for private sellers.
  • Western Australia: Both buyer and seller must complete and sign Form MR9 (Vehicle Transfer). A roadworthy inspection is not routinely required for standard transfers unless the vehicle is unlicenced or modified.

Calculating motor vehicle transfer duty and fees

When lodging the transfer, the buyer pays state motor vehicle transfer duty (commonly called stamp duty) plus an administrative transfer fee. The duty is calculated as a percentage of the vehicle's dutiable value.

Dutiable value is legally defined as the purchase price or the current market value, whichever is higher. Some buyers attempt to under-declare the sale price to save a few hundred dollars on stamp duty.

State revenue offices routinely audit transfers against market valuation databases. If the declared purchase price is suspiciously lower than typical market transactions for that year and model, the department will issue a reassessment notice demanding back-taxes and penalties.

The critical risk: transferring a car with encumbered finance

Transferring registration transfers the administrative permit to drive the vehicle on public roads. It does not transfer unencumbered legal ownership.

In Australia, vehicle debt attaches to the vehicle itself on the Personal Property Securities Register (PPSR). If the seller owes money on a car loan and ceases repayments after the sale, the lender has the statutory right to repossess the car directly from your driveway.

Never sign the transfer papers or transfer funds until you have independently checked the registration plate or VIN on the national PPSR and verified that no security interest is recorded against the car.

Common questions

How long do I have to transfer car registration after buying privately in Australia?
In most Australian states and territories (including NSW, Victoria, and Queensland), the buyer has 14 days from the date of sale to lodge the transfer of registration and pay transfer duty.
Does the seller have to provide a roadworthy certificate when selling a car?
In Queensland and Victoria, a valid roadworthy or safety certificate is mandatory to complete a private transfer. In NSW, registration renewal requires an annual pink slip if the vehicle is over five years old.
Does transferring registration clear outstanding finance on the car?
No. Registration is an administrative permit, not proof of legal title. A registered security interest remains attached to the vehicle. Always verify clear title via an official PPSR certificate before signing.
